Affiliate Agreement
Effective Date: 07/09/2025
Company: The PK Labs™ (A division of The EMM Group LLC)
 

1. Introduction

This Affiliate Program Agreement ("Agreement") is between you ("Affiliate") and The PK Labs™, an innovation brand of The EMM Group LLC. By joining our program, you agree to comply with all terms outlined herein while promoting our products, including the PK Putter™.
 

2. Eligibility Requirements

• You must be at least 18 years of age.

• Required account info includes valid email, city, and country.

• You may not promote our products on platforms that include illegal, adult, or hateful content.
   

3. Commission Structure & Payment Terms

• Affiliates will earn a base commission of 15% on each qualifying product purchase.

• Commission is calculated on the product subtotal, excluding shipping, taxes, and discounts.

• Minimum payout threshold: $50 USD. Commissions below this will roll over month-to-month.

• Payouts are issued on the 1st of each month via your selected method (e.g., PayPal).

• Affiliates are responsible for keeping accurate payout details in their account.
   

4. Promotional Guidelines

• Promote The PK Labs™ products in a truthful and ethical manner.

• No spam, fake reviews, misrepresentation, or bot traffic allowed.

• Affiliates may not bid on branded keywords (e.g., "The PK Labs™," "PK Putter™") without written consent.

• All promotions must follow FTC disclosure regulations and properly identify affiliate relationships.
   

5. Brand Use & Intellectual Property

Affiliates may use logos, images, and content from our official affiliate portal only for the purpose of promoting PK Labs™ products.

The following names, brand marks, taglines, and any variations in spelling, stylization, or phrasing are exclusive intellectual property of The EMM Group LLC and are protected under this agreement:

Affiliates may not:

• Modify, copy, or rebrand any logos, taglines, or visual assets provided by The PK Labs™

• Use any of the above brand names (or confusingly similar variations) in social media handles, domain names, ad campaigns, product descriptions, or external promotions without prior written consent

• Register or imply ownership over any intellectual property owned by The EMM Group LLC

Any unauthorized use, duplication, or misleading representation of these brand assets will result in immediate termination from the affiliate program and may result in legal action to protect the brand and its reputation.
 

6. Disclaimers & Limitation of Liability

• The PK Labs™ does not guarantee any specific income or performance results.

• The EMM Group LLC is not liable for indirect, incidental, or consequential damages of any kind.
   

7. Modification of Terms

• The PK Labs™ reserves the right to update or change this Agreement at any time.

• Continued participation in the program indicates your acceptance of any updates.
   

8. Termination

• The PK Labs™ may terminate your affiliate status at any time for violating program policies or unethical behavior.

• You may also leave the program at any time with no penalty by ceasing promotional activity.
   

9. Governing Law & Dispute Resolution

• This Agreement shall be governed by the laws of the State of California, USA.

• Any disputes shall be resolved through binding arbitration under California law.
   

10. Legal & Ownership Notes

• This program is operated by The EMM Group LLC, headquartered in California.

• You are responsible for any tax reporting required by your local jurisdiction.

• All affiliates operate as independent marketers, not as employees or agents of The PK Labs™ or The EMM Group LLC.
   

11. Final Acknowledgment

By registering for and participating in the The PK Labs™ Affiliate Program, you acknowledge that you have read, understood, and agree to all the terms of this Agreement. You also understand that violation of these terms may result in account suspension or removal.
